This Agreement contains important information that you are entitled to receive before you consent to receive electronic records & documents.
This Agreement is between Pathway Homes and its affiliates (“Pathway”), and you as our customer(s). Please read the following terms and conditions carefully.
To the extent permitted by law, you agree and consent to receive by electronic means all records, documents, notices, and disclosures(“Documents”) that may be provided, delivered, or otherwise made available during the course of your relationship with Pathway. As permitted by the consent you are providing and applicable law, Pathway will replace paper delivery of Documents with electronic delivery at our sole discretion as electronic delivery of documents becomes available. By providing consent, you agree to delivery of Documents to you in the following manner, in lieu of delivery by mail:
Pathway may send you emails transmitting Documents, whether as text in, attachments to, and/or hyperlinks within emails. Such emails will be sent to the current email address we have on file for you. You are responsible for providing a valid email address to which you have regular access, and you are responsible for immediately notifying Pathway of any change of email address. Notice of any change to your email address must be sent by email to [Pathway email address] and in the body of such email include your previous email address and your new email address. You are responsible for ensuring that neither your software nor your Internet service provider inhibits or interferes with the Documents and communications described herein.
Upon receipt of an email, you will be able to view the Document (if in the text of an email). If the Document is an attachment or accessible via a hyperlink, you must open the attachment or click on the hyperlink in order to access the Document. In either instance, you will need Adobe Reader in order to access a PDF file. If you do not have Adobe Reader on your computer or device, you may download it for free at Adobe.com.
Please note that applicable law may require us to send certain Documents in writing to you by a specified manner, such as by U.S. mail, regardless of this Agreement, and Pathway will continue to do so.
You may withdraw your consent at any time by sending an email to [Pathway email address] and in the body of such email including your request to withdraw your consent to electronic delivery.
As detailed below, you have the right to receive Documents by mail at no additional charge without withdrawing consent for electronic delivery. If you choose to withdraw your consent to this Agreement, you will not be able to receive Documents electronically from us any longer. We will resume mailing to you paper copies of documents if we receive notice that your consent has been withdrawn.
You may obtain paper copies by: (1) printing the Document at your printer; (2) sending an email to [Pathway email address] and in the body of such email include a request for a paper copy of the Document; or (3) call Pathway Customer Service at [phone number] to request a paper copy.
To use the services described in this Agreement, you must have access to a computer or mobile device. If you would like to save documents that you receive, the computer or device must have physical storage or access to cloud data storage or be connected to a printer. You must also have an email account to receive and view communications. Reviewing Documents requires the following minimum hardware and software requirements:
Browsers: Windows Edge Current Version, Mozilla Firefox Current Version, Safari Current Version, Google Chrome Current Version
Mobile: Apple or Android
PDF Reader: Acrobat Reader or similar software might be required to view PDF files
